1. Acceptance of Terms

By accessing or using ScamShield ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. The Service is operated by Werner Rall from within the Republic of South Africa.

2. Description of Service

ScamShield is a fraud risk assessment tool that aggregates publicly and lawfully available signals to produce a risk score for websites, phone numbers, email addresses, and bank account details. The Service provides risk indicators only — not definitive identity verification.

ScamShield does not guarantee the accuracy of any result. Risk scores are based on automated analysis and third-party data sources that may be incomplete, delayed, or incorrect.

3. Permitted Use

You agree to use ScamShield only for:

• Personal fraud risk assessment before making transactions
• Reporting suspected scams for community benefit
• Accessing fraud escalation contact information

4. Prohibited Conduct

You may NOT use ScamShield to:

• Harass, stalk, or intimidate any person
• Submit false scam reports or abuse the reporting system
• Attempt to identify, expose, or dox private individuals
• Scrape, harvest, or bulk-extract data from the Service
• Reverse-engineer, decompile, or attempt to access the source code
• Circumvent rate limits, security controls, or access restrictions
• Use automated tools, bots, or scripts without prior written consent
• Resell, redistribute, or commercially exploit results from the Service

5. Accuracy & Limitations

ScamShield provides risk indicators based on available data at the time of the check. You acknowledge that:

• A "low risk" result does not guarantee that a party is legitimate or trustworthy
• A "high risk" result does not confirm that a party is fraudulent
• Third-party data sources may contain errors, omissions, or outdated information
• You are solely responsible for your own financial and personal decisions

6. User-Submitted Scam Reports

When you submit a scam report, you represent that:

• The information you provide is truthful and submitted in good faith
• You are not using the reporting system for harassment, defamation, or competitive sabotage

We reserve the right to moderate, reject, or remove any report at our sole discretion. Submitting a false report may result in account suspension or legal action.

7. Intellectual Property

All content, code, algorithms, branding, and design of ScamShield are the exclusive intellectual property of Werner Rall. No part of the Service may be reproduced, distributed, or modified without explicit written permission.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of Liability

To the maximum extent permitted by South African law, Werner Rall and ScamShield shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the Service, including but not limited to financial losses resulting from reliance on risk scores.

10. Indemnification

You agree to indemnify, defend, and hold harmless Werner Rall and ScamShield from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

11. Service Availability

We aim to keep ScamShield available at all times but do not guarantee uninterrupted access. We may suspend or discontinue the Service at any time without notice for maintenance, security, or other reasons.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via a notice on the website. Continued use of the Service after changes constitutes acceptance of the updated Terms.
